You agree to provide Financial SMSs, contacts, location data, installed applications, storage and such other device data of yourself in the course of availing Services.
In respect of any transactions which may be permitted by MVFL from time to MVFL’S own records of such transactions, maintained through computer systems or time, otherwise, shall be accepted as conclusive and binding for all particularly, the purposes. More record of MVFL generated by the transaction(s), recording of the including time of the transaction(s), shall be conclusive proof of the genuineness and accuracy of such transactions.

8. Limitation of liability
In no event shall we be liable for any direct, indirect, punitive, incidental, special consequential damages or for any damages whatsoever including, without limitation, damages for loss due to use, data or profits, arising out of or in any way connected with the access, features or for interruptions, delay, etc., even if we were advised of the possibility of damages resulting from the cost of getting substitute facilities on the website, any products, data, information or services purchased or obtained or messages received or transactions entered into through or from the platform, unauthorized access to or alteration of your transmissions or data statements or conduct of anyone on the platform, or inability to use the platform, the provision of or failure to provide the functions and features, whether based on contract, tort, negligence, strict liability or otherwise. 11. Force Majeure
The NBFC (MVFL) shall not be liable if any transaction does not fructify or may not be completed or for any failure on part of the NBFC to perform any of its obligations under these Terms and Conditions or those applicable specifically to its services/facilities if performance is prevented, hindered or delayed by a Force Majeure event (defined below) and in such case its obligations shall be suspended for so long as the Force Majeure event continues.
Force Majeure Event” means any event due to any cause beyond the reasonable control of the NBFC, including without limitations, unavailability of any communication systems, breach, or virus in the processes or payment or delivery mechanism, sabotage, fire, flood, explosion, acts of god, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised accesS to computer data and storage devices, computer crashes, malfunctioning in the computer terminal or the systems getting affected by any malicious, destructive or corrupting code or program, mechanical or technical errors/failures or power shut down, faults or failuress in telecommunication etc.

12. Payment Gateway
Use of payment gateway of “PAY U” is optional. Mangal Vehicle Finance Pvt Ltd shall not be responsible for any loss/damages/liability if any suffered by the borrower/customer in the process of use of this payment gateway. This facility shall be used for payment of monthly installment and charges due to customer. MVEL has offered online payment priviledged to its Borrower/Customer as per charges prescribed by NBFC (MVFL). However MVFL reserves the right to levy any service charges as applicable from time to time in consideration for the services provided herein to the user. In case user is not consenting to any service charges then, user may opt out of payment gateway services.
